1.1 We, "Us," or "Ulence" are pleased to welcome you to ulence.com. When you browse or shop at ulence.com,ulence.com offers you website features as well as additional goods and services.

The Website is operated by ulence.com, a company incorporated under the laws of Bangladesh having its registered office (Registration Number: Ulence-643965890 ) at 875, East Shewrapara, Mirpur, Kafrul, Dhaka - 1216, Bangladesh. All references to the Website in these Terms shall deem to refer to the aforesaid entity in inclusion of the online portal.

1.3. This website might connect to other websites that are not run by Ulence. Ulence has no control over those websites and disclaims all liability for any losses or damages that may result from your use of those websites. The terms of use and service outlined on each of the linked websites will apply to your usage of those websites.

1.4. The Site maintains the right, without prior notice, to change, modify, add, or remove any part of these Terms and Conditions at any time.

1.5. In accordance with, (Information & Communication Technology Act, 2006) and rules there under as applicable and as amended from time to time, the materials listed here constitute an electronic record. As a result, neither a physical nor digital signature is necessary for this agreement to be legal and enforceable between the Website and the User.

4.3. If you want to make an account on the website, you must do so by providing a valid Bangladeshi mobile number, your email address, or the relevant information on the website registration form. After that, you'll have a password or one-time PIN that you can use to access the website and place orders.

4.4. If you use the website, you are in charge of protecting the privacy of your username and password, as well as any actions taken under your username. You must also restrict access to your computer or mobile device to prevent unauthorized users from accessing your account.If you have any cause to suspect that someone else knows your password or if you feel it is now being used or going to be used in an unlawful manner, you should let us know right once. 6.1. ulence.com, its subsidiaries, affiliates, and/or third-party licensors are the owners of the content, as well as any other materials, software, or services, that are available on ulence.com. Without express consent from ulence.com, no part of this website may be copied, duplicated, reprinted, installed, posted, transmitted, stored, or distributed.

7. The Agreement:

7.1 .Your order constitutes a purchase proposal to us for the item(s) listed therein. When you order a product from us, you will receive an email and/or SMS to your mobile phone number (the "Order Confirmation E-mail and/or SMS") confirming receipt of your order and/or providing the specifics of your order. Although we acknowledge receiving your order through email and/or SMS, it does not mean that we have accepted your offer to acquire the ordered item(s).According to Section 4(3) of the Sale of Goods Act, 1930, when we send the Order Confirmation E-mail and/or SMS, a contract known as a "agreement to sell" is made; this means that the transfer of ownership in the goods will happen at a later time, when the product(s) are delivered to your specified address. According to Section 4(4) of the Sale of Goods Act, 1930, we only accept your offer, and the aforementioned "agreement to sell" turns into a contract of sale for the product(s) you've ordered, when the product(s) are delivered to the address you've specified and ownership of the goods passes from us to you at that point.

8. Product delivery:

8.1. In case of home delivery, products of any weight can be delivered up to the 2nd floor. But in case of higher height, up to 15 kg of the product will be subject to the existing delivery charge; if more than this, an extra cost of Tk 10 will be applicable for every additional 5 kg of weight. However, if there is a lift, no extra charge will be applicable.

8.2. We try our best to deliver the goods within the same day of the order, and then if for any reason the delivery of the goods is interrupted on the same day, we ensure it within the next 24 hours In sha Allah.

8.3. Delivery may take longer than the typical timetable or line that ULENCE will follow. Please take into account and compute the advertised timeframe as working days and keep in mind that the delivery timeframe is simply an estimate. Depending on the conditions, it could change. Force majeure events, such as political instability, political events, national/public holidays, official holidays, pandemics, etc., as well as supplier delays for large volumes of orders and logistic partners, such as courier services, may cause delivery to be delayed.

8.4. Orders placed after 5 PM will be processed the following business day. Governmental and public holidays are not included in our business days.

9. Disclaimer:

9.1. You agree to use your best and most cautious judgment before engaging in any transactions through the Site, and you realize that you are accessing the services on the Site at your own risk. We clearly renounce all duty and obligation in this regard and promise that we will not be held liable or responsible for the sellers' actions or inactions or for any breach of the terms, representations, or guarantees made by the sellers or the product's manufacturers. Any disagreements or disputes between you and the product's vendors or makers are not our responsibility to mediate or resolve.

৭.১. .আপনার অর্ডারটি এতে তালিকাভুক্ত আইটেম(গুলির) জন্য আমাদের কাছে একটি ক্রয় প্রস্তাব গঠন করে। আপনি যখন আমাদের কাছ থেকে একটি পণ্য অর্ডার করেন, তখন আপনি আপনার মোবাইল ফোন নম্বরে একটি ইমেল এবং/অথবা SMS পাবেন ("অর্ডার নিশ্চিতকরণ ই-মেইল এবং/অথবা এসএমএস") আপনার অর্ডারের প্রাপ্তি নিশ্চিত করে এবং/অথবা আপনার অর্ডারের সুনির্দিষ্ট তথ্য প্রদান করে। যদিও আমরা ইমেল এবং/অথবা এসএমএস এর মাধ্যমে আপনার অর্ডার প্রাপ্তির কথা স্বীকার করি, এর মানে এই নয় যে আমরা অর্ডারকৃত আইটেম (গুলি) অর্জন করার জন্য আপনার প্রস্তাব গ্রহণ করেছি। পণ্য বিক্রয় আইন, ১৯৩০ এর ধারা ৪(৩) অনুসারে, যখন আমরা অর্ডার নিশ্চিতকরণ ই-মেইল এবং/অথবা এসএমএস পাঠাই, একটি চুক্তি "বিক্রয় করার চুক্তি" নামে পরিচিত; এর মানে হল যে পণ্যের মালিকানা হস্তান্তর পরবর্তী সময়ে ঘটবে, যখন পণ্য(গুলি) আপনার নির্দিষ্ট ঠিকানায় পৌঁছে দেওয়া হবে। পণ্য বিক্রয় আইন, ১৯৩০ এর ধারা ৪(৪) অনুসারে, আমরা শুধুমাত্র আপনার প্রস্তাব গ্রহণ করি এবং উপরে উল্লিখিত "বিক্রয় করার চুক্তি" আপনার অর্ডারকৃত পণ্য(গুলি) বিক্রয়ের চুক্তিতে পরিণত হয়, যখন পণ্যটি (গুলি) আপনার নির্দিষ্ট ঠিকানায় বিতরণ করা হয় এবং সেই সময়ে আমাদের কাছ থেকে পণ্যের মালিকানা আপনার কাছে চলে যায়।

৮. পণ্য বিতরণ:

৮.১. হোম ডেলিভারির ক্ষেত্রে, যেকোনো ওজনের পণ্য ২য় তলা পর্যন্ত ডেলিভারি করা যাবে। কিন্তু উচ্চতার ক্ষেত্রে, পণ্যের ১৫ কেজি পর্যন্ত বিদ্যমান ডেলিভারি চার্জ সাপেক্ষে; এর বেশি হলে প্রতি অতিরিক্ত ৫ কেজি ওজনের জন্য ১০ টাকা অতিরিক্ত মূল্য প্রযোজ্য হবে। তবে লিফট থাকলে কোন অতিরিক্ত চার্জ প্রযোজ্য হবে না।

৮.২. আমরা অর্ডারের একই দিনের মধ্যে পণ্য সরবরাহ করার জন্য আমাদের যথাসাধ্য চেষ্টা করি এবং তারপরে যদি কোনও কারণে একই দিনে পণ্য সরবরাহ বাধাগ্রস্ত হয় তবে আমরা পরবর্তী ২৪ ঘন্টার মধ্যে তা নিশ্চিত করব ইনশাআল্লাহ।

৮.৩. ডেলিভারিতে ULENCE যে সাধারণ সময়সূচী বা লাইন অনুসরণ করবে তার চেয়ে বেশি সময় লাগতে পারে। অনুগ্রহ করে বিবেচনা করুন এবং কাজের দিন হিসাবে বিজ্ঞাপিত সময়সীমা গণনা করুন এবং মনে রাখবেন যে বিতরণের সময়সীমাটি কেবল একটি অনুমান। অবস্থার উপর নির্ভর করে এটি পরিবর্তন হতে পারে। জোরপূর্বক ঘটনা, যেমন রাজনৈতিক অস্থিতিশীলতা, রাজনৈতিক ঘটনা, জাতীয়/পাবলিক ছুটি, সরকারী ছুটি, মহামারী ইত্যাদি, সেইসাথে প্রচুর পরিমাণে অর্ডার এবং লজিস্টিক অংশীদারদের জন্য সরবরাহকারীর বিলম্ব, যেমন কুরিয়ার পরিষেবা, ডেলিভারি বিলম্বিত হতে পারে ।

৮.৪. বিকেল ৫ টার পরে অর্ডারকৃত পণ্য র্পরবর্তী ব্যবসায়িক দিনে প্রক্রিয়া করা হবে। সরকারী এবং সর্বসাধারণের ছুর্টির দিন আমাদের কর্মদিবসের অন্তর্ভুক্ত নয়।

৯. দাবিত্যাগ:

৯.১. আপনি সাইটের মাধ্যমে যেকোনো লেনদেনে জড়িত হওয়ার আগে আপনার সর্বোত্তম এবং সবচেয়ে সতর্ক রায় ব্যবহার করতে সম্মত হন এবং আপনি উপলব্ধি করেন যে আপনি নিজের ঝুঁকিতে সাইটের পরিষেবাগুলি অ্যাক্সেস করছেন। আমরা স্পষ্টভাবে এই বিষয়ে সমস্ত কর্তব্য এবং বাধ্যবাধকতা পরিত্যাগ করছি এবং প্রতিশ্রুতি দিচ্ছি যে বিক্রেতাদের ক্রিয়াকলাপ বা নিষ্ক্রিয়তার জন্য বা বিক্রেতা বা পণ্যের প্রস্তুতকারকদের দ্বারা করা শর্তাবলী, উপস্থাপনা বা গ্যারান্টিগুলির কোনও লঙ্ঘনের জন্য আমরা দায়বদ্ধ বা দায়ী থাকব না। আপনার এবং পণ্যের বিক্রেতা বা নির্মাতাদের মধ্যে কোনো মতবিরোধ বা বিরোধের মধ্যস্থতা বা সমাধান করার দায়িত্ব আমাদের নয়।
